We at Ikaslé Business Group strive to engage with our clients in a professional, timely, and favorable manner. By choosing to work with Ikaslé Business Group, you agree to the following terms and conditions:
The Contract
When you engage our services, an independent contractor relationship is established between you and Ikaslé Business Group. This agreement does not create a partnership or joint venture.
- Commencement Date: We will mutually agree on the start date for our services. All charges will be based on this date.
- Monthly Performance Reports: You will receive a monthly report detailing the performance of our services.
- Service Cancellation or Transfer: Neither party may cancel or transfer service responsibilities to another provider without giving at least 30 business days' notice.
- Subcontracting: We reserve the right to subcontract third-party service providers for specific tasks as needed.
- Third-Party Rights: This contract does not grant any rights to individuals or entities not part of the agreement.
Payment
- Monthly Service Packages: For monthly services, payment in full is required before work begins.
- Fixed Quote Services: If a fixed quote is agreed upon, 50% of the payment is due in advance, with the remaining 50% payable within 7 days of the service start date.
- Invoicing: We will invoice you monthly, in advance.
- Non-Payment: If you fail to pay a monthly invoice on time, we will terminate services immediately without prior notice.
Refund & Cancellation Policy
- Project Milestones: We plan projects by dividing the work into milestones. Each project starts with a thorough discovery and analysis phase to create a scope of work document. This ensures mutual understanding and minimizes cancellations or disputes.
- Completed Work: Refunds are not possible for completed work.
- Mutual Termination: If a project is terminated mutually, you will retain control of all completed work, and any future payments will be void. However, no previous payments or deposits will be refunded.
- Mock-Up Designs: Once you approve mock-up designs and we enter the development phase, no refunds will be issued.
- Milestone Phases: No partial refunds are given for projects midway through a milestone phase.
- Special Offers: Services offered on special occasions are non-cancellable and non-refundable.
- Service Cancellation: You may cancel services with a 30-day written notice.
- Dormant Projects: No refunds will be issued for projects that are abandoned or dormant for more than 30 days.
Liability
- Service Delays: We are not liable for indirect or consequential losses due to service delays caused by natural or unavoidable events.
- Indemnification: You agree to indemnify and hold Ikaslé Business Group harmless from any claims, losses, liabilities, and expenses related to the services provided, including claims made by third parties for issues such as false advertising, liability for products or services sold, intellectual property infringement, service disruptions, or content you submit for publication.
- Content Accessibility: Given the nature of digital media, any content you provide for publication will be publicly accessible once published. We are not responsible for screening this material or any resulting damages.
Waiver
Failure to insist on strict performance of any obligations under the service contract or these terms does not constitute a waiver. Waivers are only valid if communicated in writing.
Privacy Rights
- Confidentiality: Information you provide, such as name, email, contact number, and website URL, will be kept confidential and not shared without your consent, except with Ikaslé Business Group employees.
- Data Security: We will take reasonable precautions to prevent the loss, misuse, or alteration of your personal information. However, data transfer over the internet is inherently insecure, and we cannot guarantee complete security.
- SSL Technology: We use SSL-encrypted technology for financial transactions to protect against online theft and fraud.
- Cookies: Cookies are used to track browsing information and preferences. We may use cookies for statistical data to optimize our site. Third-party advertisers on our site may also use cookies, but they do not access your personal information.
Modification of Terms
Ikaslé Business Group reserves the right to modify these terms and conditions at any time, even during an ongoing contract. Changes will be communicated via company email.
Entity Clarification
Ikaslé Group, InsightED, InsighteEd Education Solutions, Insighted, StratagemXcel, StratagemXcel Biz, StratagemXcel Business Solutions, Ikasle, Ikaslé, and Ikaslé Business Group all refer to the same entity: Ikaslé Business Group.
